Personal Data We Process

When you enter into a contract with us, we process the following data:

Personal Information

  • First and last name
  • Full address
  • Contact details (e.g. email address, telephone number)
  • Information regarding the type and content of the contract

We may also process other personal data that you or a third party provide with your consent, during the initiation of the contract, throughout the contractual relationship (e.g. when issuing a guest card), or where required by law, including:

  • Date of birth or age
  • Marital status
  • Gender
  • Occupation
  • Identification document details
  • Bank account information
  • Authorization or representation rights
  • Contractual obligations
  • Notice periods
  • Any other personal information voluntarily provided by you

Use of Data Processors

The protection of your personal data is very important to us. Even when we use external data processors such as Smoobu.com and Feratel Guest Directory pursuant to Section 19 of the Austrian Registration Act (Meldegesetz), we ensure that all data is processed within the European Union.

1. Registration Data

1.1 Registration Requirement

Under Austrian registration law, guests are required to register with us and provide the information specified in Sections 5 and 10 of the Austrian Registration Act.

This includes:

  • Name
  • Date of birth
  • Gender
  • Nationality
  • Country of origin
  • Address including postal code

Foreign guests must additionally provide:

  • Type of travel document
  • Travel document number
  • Place of issue
  • Issuing authority
  • Arrival date
  • Departure date

1.2 Guest Register

We are legally required to maintain a guest register in accordance with Section 19 of the Austrian Registration Act and to retain this information for seven (7) years, unless longer processing periods apply under this Privacy Policy.

The guest register is maintained electronically and stored locally by an authorized IT service provider. No data is transferred to third countries.

1.3 Disclosure of Data

Arrival and departure dates, together with the guest’s country of origin, are transmitted to the municipality in which our accommodation establishment is located in accordance with Section 6 of the Austrian Tourism Statistics Regulation.

Aggregated information regarding the total number of overnight stays and the names of persons subject to local tourism tax may also be transmitted to the relevant tourism association, Stubai Tourism Association, of which we are a member. This is carried out pursuant to Section 9 of the Tyrolean Accommodation Tax Act.

1.4 Legal Basis for Processing

The processing described in Sections 1.1 to 1.3 is based on Article 6(1)(c) GDPR (compliance with a legal obligation).

1.5 Additional Data Transfer to the Tourism Association and Municipality

We also transmit your postal code and year of birth in pseudonymized and anonymized form to the municipality and tourism association for statistical purposes. This enables the tourism association to prepare and evaluate statistics relating to guests’ countries of origin and age groups.

The legal basis for this processing is Article 6(1)(e) GDPR (public interest) and Article 6(1)(f) GDPR (legitimate interests).

You have the right to object to this processing at any time on grounds relating to your particular situation pursuant to Article 21(1) GDPR.

2. Guest Card

2.1 General Information

Guests may use a guest card which provides discounts and/or services from various regional businesses (for example reduced admission fees).

The guest card is valid for the duration of your stay.

2.2 Issuance of Guest Cards

Guest cards are issued only upon request.

Depending on the guest card system used by the tourism association and/or accommodation provider, guests may receive one of the following:

  • Electronically generated guest card
  • Manually issued guest card
  • Copy of the registration form

2.3 Personal Data Processed for Guest Cards

For both electronically generated and manually issued guest cards, the following personal data is processed based on registration data:

  • First name
  • Last name
  • Date of birth
  • Duration of stay (arrival and departure dates)
  • Country of origin
  • Postal code
  • 2.4 Legal Basis for Processing
  • Data is processed for guest card purposes either:
  • on the basis of your consent pursuant to Article 6(1)(a) GDPR, or
  • for the performance of a contract pursuant to Article 6(1)(b) GDPR, where the guest card forms part of the services agreed under the accommodation contract.

  • 2.5 Guest Card System Administration
  • The guest card system is administered by the local tourism association.
  • Other participants include local accommodation providers and regional service providers.
  • Data processed for guest card purposes will be deleted after forty-eight (48) months.
  • 2.6 Recipients of Data
  • Data processed in connection with the guest card may be transmitted to the local tourism association in order to facilitate settlement with participating service providers and accommodation establishments.
  • Individual service providers offering discounted services through the guest card may also receive relevant data when you make use of their services.
  • To claim discounts, you must present the guest card to the service provider.
  • The service provider verifies the validity of the card, typically by scanning the barcode and transmitting the barcode data to our IT service provider.
  • Personal data required to verify your identity and date of birth may also be transmitted.
  • If the guest card consists of a copy of the registration form, the service provider verifies its validity based on the information contained therein.
  • 3. Additional Processing of Your Data
  • As a general rule, we only process personal data that is necessary for the conclusion and performance of the contract.
  • However, with your consent and until such consent is withdrawn, we may also provide you with information about our services.

  • 4. Deletion of Data
  • Your personal data will be deleted once it is no longer required to comply with statutory retention obligations, typically after seven (7) years, or where storage is no longer legally permitted.
